Michele Bachmann drops out of leadership race

Wonderful news. They both are terrific conservatives, and it’s good to see that they are not going to allow the media to divide them and have them fight each other. I also think that the GOP leadership in the House should be as conservative as possible, but not flashy and polarizing (at least not because of personality). This would deny the Dems a target like we have in Pelosi and Obama.

This will allow Bachmann to do what she does best, be the partisan conservative that debates the MSM, without having her partisanship turn off the squishy middle, as would happen if she is part of the GOP leadership.

My guess is that she’s flexed her muscles, proved that she’s a force to be reckoned with, and will let Hensarling (who also is a perfectly good conservative) get the nod. Michele can now concentrate on legislation, and may be thinking about perhaps running for the Senate in 2012 against Klobuchar (although she may prefer to wait until 2014 for the lower-hanging fruit, Al Franken).

The U.S. Army says a surgeon who has publicly refused to follow any further orders until he sees documentation that Barack Obama is eligible to be president is being "reassigned" at Walter Reed Army Hospital after he refused to deploy to Afghanistan as scheduled.

Lt. Col. Terry Lakin is the highest-ranking and first active-duty officer to refuse to obey orders based on President Obama's eligibility.
While there have been reports Lt. Col. Terry Lakin is facing an imminent court-martial, Army spokesman Chuck Dasey told WND today that Lakin is only "under investigation" at this point.

Washington will not be able to fill that void in medical innovation because government command and control of health care is incapable of fostering innovation. Countries with government-controlled (socialized) medicine have proven that government is only capable of limiting patient access to care (rationing) or setting artificial prices (price-fixing), both of which stifle innovation, reduce patient access, and lead to lower quality of care.

The Ten Action Recall States

Ten states—Arizona, Colorado, Louisiana, Michigan, Montana, New Jersey, North Dakota, Oregon, Washington and Wisconsin—have clear constitutional or statutory provisions for recall of all elected officials. Together, these states have 13 incumbent U.S. Senators not standing for re-election in 2010, but, in which, successful petition drives could put any or all of them either on the November ballot or in a special election.

States With Other Recall Provisions

Eight other states have more narrowly defined recall provisions that evidently do not cover elected federal officials. They include: Alaska, California, Georgia, Idaho, Kansas, Minnesota, Nevada, and Rhode Island.
Here, it will be necessary to encourage the state legislatures to extend their recall provisions to cover federal officials. The language should be modeled on that of New Jersey:

“The people reserve unto themselves the power to recall, after at least one year of service, any elected official in this State or representing the State in the United States Congress. The Legislature shall enact laws to provide for such recall elections.”

States with Other Remedies

Several other states, while not having recall provisions, do have the Initiative Process, by which citizens propose statutes or constitutional amendments and place them before voters for approval. These include: Arkansas, Florida, Idaho, Illinois, Maine, Massachusetts, Mississippi, Missouri, Nebraska, Ohio, Oklahoma, South Dakota, Utah and Wyoming.
Here, the initiative process can be used to make a recall provision legal. The language in the initiative, again, should reflect that of New Jersey and specifically read: “The people reserve unto themselves the power to recall, after at least one year of service, any elected official in this State or representing the State in the United States Congress. The Legislature shall enact laws to provide for such recall elections.”

If you live in a state without a recall provision or initiative process, the only remedy is to elect state representatives who favor these provisions and who might propose state constitutional amendments to establish them.

Napolitano.

In an exclusive interview with Newsmax.TV's Ashley Martella, Napolitano says the president's healthcare reforms amount to "commandeering" the state legislatures for federal purposes, which the Supreme Court has forbidden as unconstitutional.

"The Constitution does not authorize the Congress to regulate the state governments," Napolitano says. "Nevertheless, in this piece of legislation, the Congress has told the state governments that they must modify their regulation of certain areas of healthcare, they must surrender their regulation of other areas of healthcare, and they must spend state taxpayer-generated dollars in a way that the Congress wants it done.

Do the States Hold the Answer to a Runaway Congress?

The state of New Jersey provides in Article 1 Section 2b of its Constitution that:

Eight other states—Colorado, Louisiana, Michigan, Montana, North Dakota, Oregon, Washington and Wisconsin—have laws on their books providing for broad recall of elected officials, which could include Members of Congress. Altogether, these nine states have 12 incumbent Senators in the runaway Congressional majority who are not already standing for re-election in 2010, but, in the event of successful petition drives, could be.

Let's all pause here for a moment so liberals can Google the term 'free market.' Nearly every problem with health care in this country -- apart from trial lawyers and out-of-date magazines in doctors' waiting rooms -- would be solved by my plan. In the first sentence, Congress will amend the McCarran-Ferguson Act to allow interstate competition in health insurance. We can't have a free market in health insurance until Congress eliminates the antitrust exemption protecting health insurance companies from competition. ... The very next sentence of my bill provides that the exclusive regulator of insurance companies will be the state where the company's home office is. Every insurance company in the country would incorporate in the state with the fewest government mandates.... Boos as Ron Paul wins CPAC straw poll

Bill O’Reilly interviewed Stewart Rhodes, the founder of the Oathkeepers, tonight. During their discussion O’Reilly supported gun confiscation during hurricanes. He told the Oathkeeper that his views on the Second Amendment were “extreme.” Bill O’Reilly stated clearly that any mayor – such as in New Orleans after Katrina – had a perfect right to confiscate guns because they had to maintain “control.”
Huh?

Last I checked, the Second Amendment doesn’t mention anything about severe storms.
For the record, I support Bill O’Reilly on several of his positions. Not this one.
More… Glenn Reynolds added:  That’s funny. O’Reilly calls the opposing position “extreme,” but such gun confiscation is illegal under federal statute, and as a matter of constitutional law; in fact, the city of New Orleans lost a lawsuit over gun confiscation during Katrina. But then, O’Reilly’s no libertarian, to put things mildly. And he’s consistently weak on the law, also to put things mildly. Still, he should have been better briefed for this show, as he came across looking like a fool, and making his “extreme” guest look sober and well-informed by comparison.
